최근 일본에서는 과로사 방지를 위한 효과적인 대책 추진을 국가의 책임으로 규정하는「과로사 등 방지대책 추진법」이 2014년 제정․시행되었고, 과로사 등에 관한 조사연구, 교육활동․홍보활동을 통한 과로사 방지 계몽활동, 상담체제 정비, 민간단체 활동 지원과 같은 다양한 과로사 등 방지대책이 마련되기 시작했다. 법 제정이 노동시간 단축이나 근로환경 규제 강화 등 과로사 등을 제거하기 위한 직접적인 조치로 이어지기에는 한계가 있으며, 장시간 근로 및 업무 스트레스 등으로 인한 죽음을 방지하는 실효성 있는 방지 대책으로 기능하기에는 앞으로 많은 노력이 필요할 것으로 보이지만, 대표적인 과로사회로 알려진 일본에서 과로사 등에 대한 국가 차원의 방향성을 내놓고, 조사 결과에 따라 규제를 강화해 나가는 구조적 틀을 마련하기 시작했다는 점은 안전하고 건강한 노동을 위한 근무환경 개선 노력과 과로사 등에 대한 적극적인 대책 마련이 시급한 우리나라에 시사하는 바가 크다고 판단된다. 앞으로 우리나라에서도 노동자들의 안전하고 건강하게 일할 권리를 위해 과잉노동․과로사 등에 대한 여론 환기와 국민적 관심 고양, 실태조사, 과로사 등 방지를 위한 실효성 있는 법 제정과 대책 마련, 일과 생활을 조화롭게 영위해 나갈 수 있는 사회분위기 조성 등이 조속히 이루어지길 기대한다. To direct the effective enforcement of overwork death prevention methods to the responsibility of the government, Overwork Death Prevention Measures Promotion Act has been enacted and enforced in 2014. Although this enactment does not affect directly on reducing the work hours or strengthening the regulation, it still holds significance in the way that it provides the ways to handle overwork death on a national basis and the structure to strengthen the regulation according to the result of the Rqqqamp;D. Korea still lacks the discussion on overwork death prevention methods, but the change of public opinion, the increase of the public interest, the proposal of the prevention methods, and the enactment of overwork death prevention law would be required for the workers to obtain the humane rights of the labor.
