본 연구는 우리나라 비정규직의 불안정 노동이 어떻게 나타나고 있는가에 대해 분석한 것이다. 불안정 노동의 하위 영역으로 고용 불안정과 사회보장 불안정을 노동법에서의 배제와 사회보장법에서의 배제로 살펴보았다. 각 불안정성에 대한 분석은 관련 법률과 판례 및 학설들을 대상으로 하였다. 각 비정규 고용형태별로 고용 불안정과 사회보장 불안정에 차이가 있는지 살펴본 결과, 고용 불안정과 사회보장 불안정에 모두 노출되어 있는 고용형태는 특수형태근로, 용역근로, 일일(호출)근로이고, 일부 불안정한 고용형태는 시간제 근로로 나타났다. 고용에서는 불안정하지만 상대적으로 사회보장에서는 안정적인 고용형태는 기간제 근로와 파견제 근로로 나타났다. 본 연구 결과, 비정규 고용형태별로 약간의 차이는 있지만, 비정규 근로자는 고용 불안정과 사회보장 불안정에 대부분 노출되어 있는 것으로 분석되었다. This study analyzes how precarious non-standard workers are in Korea. This study examines exclusions from labour laws which mean precarious employment and exclusions from social security laws which mean precarious social security. The summary of this analysis are followings. First, economically dependent work, subcontract work and daily employed work are precarious employment and precarious social security. Secondly, part-time work is partially precarious employment and partially precarious social security. Thirdly, fixed term contracts work and agency work are precarious employment but non-precarious social security.
