TPP는 아시아·태평양 지역의 경제통합을 목표로 하는 다자간 자유무역협정으로 기술장벽, 경쟁정책, 지식재산 등과 같이 광범위한 내용을 다루고 있다. 본 연구는 TPP가 제시하고 있는 지식재산의 보호를 의약품 접근의 관점에서 파악하는 것을 목적으로 한다. 이를 위하여 본 연구는 의약품 접근과 관련된 TPP의 주요 내용을 TRIPs, 호-미 FTA, 한-미 FTA 협정문과 비교 분석하였고, 협상에 참여하고 있는 주요 국가들의 연구 사례를 의약품 접근에 한정하여 소개하였다. 협정문 분석 결과 TPP는 의약품 접근의 측면에서 회원국의 지식재산 제도와 의약품 제도에 부정적인 영향을 줄 것으로 보인다. 지식재산 제도에서는 지식재산의 목적과 범위, 특허의 범위와 보호기간이 중요한 내용이다. 의약품 제도에서는 허가, 급여, 유통 단계가 영향을 받을 수 있다. 구체적으로 허가 단계에서는 허가특허 연계와 자료독점이, 급여 단계에서는 급여 결정 방법과 절차가 부정적인 영향을 받을 것이다. 유통 단계에서는 강제실시가 제한될 것이며, 병행수입은 큰 변화가 없을 것이다. 이러한 협정문의 내용과 주요 국가들의 연구 사례를 고려하였을 때, TPP가 의약품 접근에 미치는 영향에 대한 우려는 합당한 것으로 보인다. 특히 허가 단계의 허가특허 연계와 급여 단계의 의약품 가격 결정에서의 영향이 클 것으로 예측된다. 이 밖에도 허가 단계의 특허 기준의 완화, 강화된 자료독점 제도, 급여 단계의 의약품 급여 및 가격 결정 과정에서 독립적 항소와 검토의 허용이 중요한 내용이 될 것이다. The purpose of this study is to analyze the potential effects of Trans-Pacific Partnership(TPP) Agreement on access to medicine compared with TRIPs, AUSFTA, and KORUSFTA. Based on the TPP agreement, which was available on the Wikileaks, we analyzed the clauses which are expected to affect access to medicine. We separated the clauses into general intellectual property(IP) system and pharmaceutical system which can be further classified into approval, reimbursement, and supply process. Also we analyzed articles and government reports on the prediction of TPP effect on access to medicine. TPP will have effects on access to medicine through overall IP system and pharmaceutical system. In IP system, the scope, objectives, and term of IP have changed compared with TRIPs. In pharmaceutical system, patent linkage, data exclusivity during approval process, reimbursement methods and procedure during reimbursement process will be detrimental to access to medicine. As a result, TPP is expected to strengthen IP protection and limit TRIPs flexibilities such as compulsory licenses and exceptions of patent to protect public health.
