초록

본 연구는 군사목적을 위하여 베트남과 한국에서 살포된 고엽제 피해 범위 인정의 확대경향에 따른 주요 원인을 규명하고 고엽제 문제의 해결을 위하여 한국 정부가 장기적으로 추진하여야 할 정책과제를 제시하는 것을 목적으로 하였다. 냉전시대에 베트남과 한국은 이념 대결에 따른 분쟁지역으로 고엽제 살포에 따른 피해국이 되었다. 고엽제의 주종으로 사용된 에이젠트 오렌지는 환경을 파괴하는 능력뿐만 아니라 인간의 건강을 해치는 독극물인 다이옥신을 대량 함유하고 있어 환경 및 인체에 치명적인 손상을 초래한다. 베트남 참전군인들의 집단적 요구에 따른 고엽제 피해보상정책은 미국에서 시작되어 한국으로 확산되었다. 국가에서 보상하는 고엽제 관련 질병과 고엽제 환자는 시간의 경과에 따라 증가하는 추세에 있다. 고엽제 피해 범위 인정은 시간의 경과에 따라 확대되는 경향이 있으며 한국도 이러한 영향을 강하게 받고 있다. 이의 주요원인은 의학기술의 발전에 따른 고엽제 해독성의 확인, 고엽제 관련 정보의 공개, 이해 당사자들의 조직적인 의사표시 등에 기인하고 있다. 고엽제 문제에 대응하는 우리의 정책과제로서 고엽제 피해 보상기준의 명확화, 정부 예산의 안정적 확보, 미국의 고엽제 제조회사를 상대로 한 손해배상 소송을 위한 적절한 국가 지원체계의 확립, 한국 휴전선에서 살포된 고엽제 관련 환경 영향 평가의 조속한 실시, 고엽제 피해 조사 연구의 국제적 협력 등을 제시한다.;This study focuses on identifying the major factors in acknowledging public responsibility for the victims of defoliants sprayed over Vietnam and the Republic of Korea during past military operations. The study concentrates on long term policy options of the Korean Government to resolve the conflict involving the defoliant, Agent Orange. During the Cold War, both Vietnam and the Republic of Korea were battlefields of confrontation where different political ideologies of the Cold War collided, and the two nations were severely damaged by Agent Orange, which not only destroys the environment, but also harms human beings with its toxic Dioxin. The United States initiated a compensation policy for veterans of the Vietnam War who were harmed by Agent Orange, and such action has led to similar policies in the Republic of Korea regarding victims of Agent Orange. Compensation policies are influenced by the fact that more and more diseases and patients are being linked to Agent Orange. Advances in medical technology have enabled for the further identification of harmful substances contained in the defoiliant, while the public has gained wider access to government documents and other information regarding Agent Orange. Compensation policies are also being influenced by the organized efforts of war veterans to receive adequate compensation for their sufferings. The Republic of Korea faces many challenges in resolving the conflict over Agent Orange. The Government should clearly set out reasonable standards for compensation and must secure sufficient funds to implement its compensation policy. It must also be ready to provide appropriate assistance to those victims who have initiated lawsuits against chemical companies in the United States that produced Agent Orange. In addition, an environment impact assessment should be carried out in the demilitarized zone to study the environmental impacts of Agent Orange on the Korean Peninsula. Finally, the Republic of Korea should collaborate with the United States and Vietnam in international research on the effects of Agent Orange.
