Abstract

초록

본 연구는 최근 3년간 아동들을 대상으로 교육서비스를 제공하고 있는 성공회대 멘토링서비스 사례를 중심으로 현장에서는 이용자 선택과 제공기관 경쟁이 어떻게 실현되고 있는지 정책설계와 실제 집행과정을 비교 분석하였다. 먼저, ‘이용자선택’에 대한 분석결과 이용자들은 서비스 신청 초기 서비스제공기관을 선택하고 있었으나 실제 서비스집행단계에서는 집단(group)으로 제공되는 서비스의 특성상 ‘제공기관의 이용자 선별’이 이루어지고 있었다. ‘제공기관 경쟁’에 대한 분석 결과 정부정책설계와는 다르게 실제 집행과정에서는 제공기관 간 ‘경쟁’과 ‘협력’이 동시에 일어나고 있음이 확인되었다. 이러한 연구 결과를 통해 제공기관에 대한 정확한 정보제공, 품질 평가 공개 등 이용자 만족도 제고를 위한 지원이 필요하며, 서비스 대상 및 영역에 따라 정책집행의 다양성이 존중될 수 있도록 향후 정책설계 시 고려되어야 할 것이다.;This study focuses on how the logic of user choice and provider competition operates on the front line of policy processing. To find the implementation process, this study compared the policy design and the actual enforcement process. The findings are as follows. In the initial stage of service request, users were choosing its service providers, but in the delivery of services it was the provider who was choosing its users. Unlike government policy design, ‘competition’ and ‘cooperation’ are coexisted between providers. Through the results of this study, support is needed for user satisfaction by providing accurate information about the provider, making public of quality assessment. And the diversity of policy enforcement in accordance with service targets and areas can be highly taken into account when future policies will be designed for.

Abstract

The COVID-19, declared as a pandemic, is a type of disaster that is defined as a situation where resources are insufficient to meet healthcare needs. Timely arrangement of healthcare resources in the right place can reduce disaster impact. The purpose of this study was to confirm the planned resource utilization strategy through a legal review that is the basis for disaster response, and to form issues and evidences for improving response competencies. This study employed a most similar systems design method. Japan was selected as a comparison country in consideration of regional, economic factors, and healthcare system, This study reviewed the Framework Acts of Korea and Japan on the Prevention and Management of Infectious Diseases, using the WHO’s “Pandemic Influenza Risk Management”. Although the legal provisions on human resources, supplies, structures and systems specified all the components in legal provision, there was lack of legal provisions on pandemic situations. In addition, this study found that Korea’s relatively well-organized pandemic responses were an outcome, in large part, of an effective pandemic response leadership and technological innovations and conceptual shifts that helped enhance response capacity. This study suggests that the management and healthcare resource management as a part of disaster response should be applied as a consideration for the revising pandemic related laws and policies, and that the connection should be enhanced between act on infectious disease and framework act on the management of disasters and safety.

팬데믹으로 선언된 COVID-19는, 필요한 의료수요에 비해 자원이 부족한 상황으로 정의되는 재난의 일종으로 의료자원의 시의적절한 적재적소의 배치는 국민들의 위험노출을 줄일 수 있다. 이에 본 연구는 재난대응의 근거가 되는 법률 검토를 통해 계획된 자원활용 방안을 확인하고 대응력 향상을 위한 논의 및 근거를 형성하고자 하였다. 본 연구는 비교연구방법 중 사례지향적 접근에 근거하였으며 최대유사체계로 설계되었다. 지역적, 경제적 요소, 보건의료체계를 고려하여 일본이 비교국가로 선정되었고 대한민국과 일본의 감염병 기본법 등이 WHO의 ‘Pandemic Influenza Risk Management’를 사용하여 분석되었다. 인력, 물자, 구조 및 체계에 대한 법률조항의 검토결과 구성요소들이 모두 명시되어 있으나 양국 모두 팬데믹 특성에 맞는 조항이 부족함을 확인할 수 있었다. 또한 대한민국의 강력한 컨트롤 타워를 기반으로 한 집행력과, 수용력 확장을 위한 혁신적인 기술 및 재난대응 컨셉으로의 전환이 높은 수준의 대응결과를 보여주는 것을 알 수 있었다. 이에 지속적으로 변화해 나갈 팬데믹 대응 법률 및 정책의 고려요소로서, 재난대응으로서의 팬데믹 관리와 의료자원 관리의 시각을 적용하고 재난법과의 연계성을 높일 것을 제언한다.
