본 연구는 인구정책을 인권의 관점에서 생각해보기 위한 목적으로 작성된다. 일반적으로 인구정책은 출생, 사망, 이동이라는 개인의 행동이 집단적으로 표출된 결과가 사회문제로 인식될때, 그것을 해결하고자 하는 노력이다. 인구정책을 구체적으로 정의하고, 목적을 달성하는데 사용되는 정책수단을 검토하고, 인구정책이 개인의 행동을 규제하기 때문에 인권의 문제가 결부되는 만큼 그와 관련된 인권문제를 검토한다. 또, 인권의 관점에서 본 인구사상을 살펴보고, 인구정책과 관련하여 1970년대 루마니아의 차우셰스쿠 시대를 회고하면서, 한국의 출산장려정책과인권문제의 딜레마를 검토하고, 이를 바탕으로 인권침해의 가능성이 있는 인구정책의 새로운 방향을 정립할 필요성을 강조하도록 한다. 한국의 초저출산 문제를 극복하는 방법으로 여성의 권리, 특히 기본적 인권을 침해하는 방법으로 인구정책이 시행되는 것은 곤란하며, 1960년대와1970년대의 출산억제시대의 비민주적 행태를 반복하는 것으로, 그것은 인구정책의 적폐(積弊)라고 할 만하다. 여성들의 “출산의 권리”(reproductive right)를 제한하여, 원치 않는 임신에 대해서도 낙태금지를 법제화하는 방식으로는, 초저출산 문제가 일시적으로 극복될 수 있다고 하더라도, 그것이 지속가능한 인구체제를 만들어내는데 아무런 도움이 되지 않고, 오히려 더 많은 사회경제적 문제를 야기할 우려가 있음을 지적한다. This paper aims to think about population policies from a human-rights perspective. Generally, population policies are attempts to find solutions to social problem when collective expression of individual demographic behavior such as fertility, mortality, migration are designated as social problems. This study reviews policy definition and tools, and the relevance of human rights perspective for population policies, as wells as the evolution of population thoughts on human rights, and proceed to reflect on the era of Ceaușescu in Romania, when pronatalism and decree 770 criminalize induced abortion in 1970s. This study gives a strong emphasis to the fact that we need to redirect population policy to find satisfactory solution to the conflict between population target and violation of human rights. In this regard, population policies should not accumulate past non-democratic, authoritarian practice as a way of coping with the ultra-low fertility facing this country. Instead, the government should pursue population policies which include greater concern with state of complete physical, mental and social well-being of women concerned, as well as western family-based policies particularly on financial incentives and work-life balance.
