어린이집에서의 CCTV 설치․운영과 관련하여 CCTV 설치가 아동의 안전사고 및 아동학대 예방과 근절을 위한 가장 합리적이고 바람직한 대안인가에 대한 논의를 규명하는 것이 우선적이라고 할 수 있을 것이다. 그러나 많은 논란 속에서 이미 CCTV 설치가 의무화 방안으로 시행되고 있는 현 시점에서 CCTV 설치여부의 당위성과 합법성을 논하기 보다는 본 연구에서는 관련 법률(헌법, 영유아보육법, 영유아보육법시행규칙, 개인정보보호법, 정보공개법, 정보공개법시행령)의 검토와 분석을 통해 문제점을 짚어보고, 보다 나은 운영을 위한 개선방안을 제시해 보고자함이 주된 연구목적이다. 연구결과 다음과 같은 몇 가지 개선방안을 제시하고자 한다. 첫째, 어린이집 CCTV 설치․운영이 아동안전 및 아동학대 예방이라는 ‘공공복리’를 위한다는 대주제에 적합한 조문이라면, 이에 따른 개인정보자기결정권의 제한은 반드시 법률로 규율되어 있어야 한다. 둘째, 보육교사에 대한 권리침해를 방지하기 위한 선언적이고 포괄적인 규정이 보다 명확하고 구체적인 규정으로 제시되어야 한다. 셋째, CCTV 운영(열람, 재생, 영상정보 처리)에 있어서 교사와의 원활한 의사소통의 절차를 구하는 등 최소한 근로자인 교사의 기본 인권과 권리가 침해되지 않도록 법적용이 이루어져야 할 것이다. 넷째, CCTV의 운영과 관련하여 보다 명확한 관리운영 범위 및 규정이 제시되어야 할 것이다. 다섯째, 보육교사를 포함한 보육교직원을 대상으로 한 아동학대와 예방을 위한 지속적인 교육 프로그램과 컨설팅이 이루어져야 할 것이다. 끝으로, 본 연구가 지닌 한계점과 후속연구를 위한 제언을 제시하였다. CCTV installations in a child care center are used for operations. We will be able to identify that the CCTV installation are primarily for operations. This study is a discussion of the most rational and desirable alternative to apply for a accident prevention and eradication of child abuse. However, in this study, rather than discussing the necessity and legality of whether the CCTV installed at the present time, the already CCTV installation is performed with mandatory measures in controversial laws such as the Constitution, Infants Care Act, Enforcement Rules to Act on Infants Care, Personal Information Protection Act, Official Information Disclosure Act, and Enforcement Decree of the Official Information Disclosure Act. These controversial laws point out the problems reported through the review and analysis. This study presents research for better management. We propose the following few improvements. First, the child care center CCTV installation and operation provisions for child safety and preventing child abuse is called "public welfare", whereby personal information in accordance with the limitations of self-determination must be legislated by law. Second, public welfare must be presented in a more clear and specific declaration and comprehensive regulations in order to prevent infringement of the rights of the child care teachers. Third, it should be made easy to prevent the violation of basic human rights and the rights of child care teachers, and the worker, by seeking the procedure of smooth communication of teachers when operating a CCTV(viewing, playback, image information processing). Fourth, operation of the CCTV will be given a more specific range and control regulations. Fifth, continuous education programs and consulting for child abuse and prevention should be conducted for child care staff, includes child care teachers. Finally, the limitations of this study and suggestions for future research are presented.
