본 연구는 장애인에 대한 실질적 차별시정과 평등실현의 중요한 정책수단인 적극적 조치(affirmative action)에 대한 이론적 내용과 법리적 논쟁의 주요 이슈들을 비판적으로 검토함으로써 적극적 조치의 목적론적 정당화와 수단론적 체계화의 단초를 제공하고자 하였다. 이를 위해 본 연구는 적극적 조치의 이론적 내용으로서의 기본적 가치와 역사적 발전, 그리고 장애인 관련 적극적 조치의 내용 등을 살펴봄으로써 적극적 조치의 본질적 맥락을 이해하고자 하였다. 이를 바탕으로 장애인관련 적극적 조치를 둘러싼 법리적 논쟁을 기본적 이념(평등과 기본권), 과정적 방법론(과거보상과 다양성관리), 결과적 효력(실적주의와 역차별) 등으로 구분하여 실질적 정당화의 근거를 확보하고자 하였다. 이러한 검토결과, 적극적 조치는 충분한 논리적 정당성을 갖고 있다고 판단되며, 다소간의 의견대립은 실질적 평등실현의 기본 가치위에 사회통합의 지향점으로 상당부분 해소할 수 있을 것으로 평가하였다. 아울러 이러한 목적론적 정당성을 위에 인권과 사회효용 관점의 이중접근, 다양한 영역 등 상황별 조치수단의 다양한 심사기준 논리화, 장애인 내 특성에 기반 한 차별적 조치의 체계화 등을 수단적 방안으로 제시하고 논의하였다. This study set out to review critically the major issues of theoretical content and juridical controversy about affirmative action, which is an important means of policy to rectify practical discriminations against people with disability and promote equality for them, and provide clues for the teleological justification and justification of affirmative action as a means. For those purposes, the study covered the basic values, historical development, and content related to people with disability of affirmative action as its theoretical content, trying to understand its essential context. Based on them, the investigator divided the juridical arguments over affirmative action related to people with disability into the basic ideas(equality and fundamental rights), process-based methodologies(past compensation and diversity management), and resulting efficacy(merit system and reverse discrimination) and secure grounds for its practical justification. The review results indicate that affirmative action has enough logical legitimacy and that some confrontations of opinions about it can be resolved in most parts through the discussion of human right perspectives and the goal of social inclusion efficacy based on the basic values of practical equality realization. Based on that teleological justification, the study proposed and discussed a couple of plans as means including the logical organization of various scrutinies for specific situations and their means across various fields, the systemization of discriminating measures based on the characteristics of people with disability.
