본 연구는 성폭력수사를 담당하는 경찰의 성폭력에 대한 편견과 임무인식이 이차피해 수사행동(피해자보호결여, 과잉수사, 합의종용)에 미치는 영향을 알아보고, 그 과정에서 공정성 실천(참여결정, 정보제공, 형사절차설명)의 역할을 조사하였다. 경남과 부산지역에서 성폭력 수사경험이 있는경찰관 112명으로부터 수집된 자료를 사용하여 구조방정식 모형검증을 실시하였다. 구조방정식 모형검증 결과, 성폭력에 대한 편견이 높을수록 피해자보호결여와 합의종용이 증가되는 반면, 참여결정은 감소되었다. 임무인식이 높을수록 참여결정과 형사절차설명이 증가되었다. 그러나 임무인식은 이차피해 수사행동에는 직접적 영향력을 미치지 않는 것으로 나타났다. 공정성실천의 영향력을 살펴볼 때, 참여결정은 정보제공을 증가시키고, 정보제공은 형사절차설명을 증가시키는 것으로 나타났다. 참여결정이 증가될수록 과잉수사가 감소된 반면, 형사절차설명이 증가될수록 합의종용이 증가되었다. 이차피해 수사행동의 영향력을 살펴볼 때, 피해자보호결여는 과잉수사를 증가시키고, 과잉수사는 합의종용을 증가시키는 것으로 나타났다. 연구결과를 토대로, 경찰의 공정성 실천을 증진하고 이차피해 수사행동을 감소하기 위해 성폭력에 대한 편견 변화를 위한 특화 교육, 공정성 실천 의무화를 위한 수사체계 확립, 수사행동의 자가사정체계 구축, 이중책무에 대한 지원, 성인여성 피해자를 위한 전담수사팀과 표준화된 수사지침확립의 필요성이 제안되었다. This study aims to find out the determinants of investigation behaviors of police officers, and to explore the role of justice practice in the secondary victimization process. A hypothetical model which explains the relationships among the prejudice against sexual assault, perception of mission, 3 types of justice practice(support for victim’s participation in decision-making, provision of the available service informations, explanation of criminal justice procedure), and 3 kinds of secondary victimization of police investigation(lack of sensitivity to victim, excessive investigation, pressure to compromize with the offender) was developed. Using the data collected from 112 police officers who work for the sexual-assault victims in Kyungnam and Pusan, the model was tested by a structural equation modeling. As a result of the structural equation modeling, the following were found : ①Prejudices increased the lack of sensitivity to victim and the pressure to compromise, while decreased the support for victim’s participation ; ②Perception of mission increased the support for victim’s participation and the explanation of criminal justice procedures ; ③Support for victim’s participation increased the provision of service informations, and the provision of service informations increased the explanation of criminal justice procedures ; ④Support for victim’s participation decreased the excessive investigation, while the explanation of criminal justice procedures increased the pressure to compromize ; ⑤Lack of sensitivity to victim increased the excessive investigation, and the excessive investigation increased the pressure to compromize. Based on the findings, ①the specialized training program to reduce the prejudices against sexual-assault, ②the investigation system to mandate the justice practice ; ③the development of a measurement to help the police officers to assess their own investigation behaviors, ④the special supports for the police officers’ dual missions, and ⑤the specialized investigation unit and the standardized guideline of investigation for the adult female victims were suggested as the ways to prevent from the secondary victimization, and to increase the justice practice for the police officers who work for the sexual-assault victims.
