초록

전국민에 대해 最低生活을 보장하고자 하는 國民基礎生活保障法이 시행되고 있으나 絶對貧困階層의 절반 이하만이 이 제도에 의해 최저생활을 보장받는 결과가 나타나고 있다. 이는 기초보장제도를 둘러싼 社會的 葛藤構造가 대상자수를 축소한 결과임을 밝히고자 하는 것이 본 연구의 주된 논지이다. 이를 위해 본 연구는 기초보장개념을 창안한 웹부부로부터 시작하여 베버리지 보고서, 복지국가 전성기, 복지국가 위기 이후 현재에 이르기까지 基礎保障 개념의 歷史的 展開過程을 사회적 갈등의 측면에서 고찰하였다. 이러한 역사적 조망을 통해 기초보장은 現業勤勞者, 勤勞經歷이 있는 脆弱階層, 근로경력이 없는 취약계층 순으로 保障對象의 우선순위와 보장수준의 高低에서 등급이 지어져 왔음을 밝히고 있다. 특히 대상의 우선순위에서 가장 뒤쳐지고, 보장수준에서 가장 낮은 등급을 제공받는 근로경력이 없는 취약계층이 최저생활을 보장받기 위해 필요한 社會的 機制가 무엇인지를 究明하는데 초점이 모아졌다. 현업근로자는 勞動爭議라는 수단을 사용하고, 근로경력이 있는 취약계층은 社會保險을 통하여 자신들의 기초보장을 확보하지만 근로경력이 없어 이러한 수단을 사용할 수 없는 취약계층이 기초보장을 제공받기 위해서는 사회적으로 강력한 連帶意識이 형성되어 있어야 함을 본 연구는 밝히고 있다. 戰時 平等意識이나 全社會的인 福祉權利運動의 경험이 不在한 우리 나라에서 근로경력이 없는 취약계층을 포함한 전국민에 대한 기초보장이 실질적으로 가능해지기 위해서는 사회적 연대감을 제고하는 先導的 理念體系가 형성되고 이에 대한 국민적 지지가 있어야 한다는 결론에 도달하였다. 이를 위해 본 논문에서는 인간의 보편적 권익향상을 추구하는 제반 小數集團이 연합하여 공동으로 社會改革을 추진할 것이 提案되고 있다.;This paper explores the reason why more than half of the poor are not protected by the social safety net even though the National Minimum Protection Law (NMPL) has been launched since October first, 2000 in Korea. It is argued in the paper that the national minimum cannot be easily attained by a single law. This is because providing the national minimum is not a simple policy sought by a political party but an essence of the welfare state which is synthesis of the conflict and compromise among the various social groups. The historical review of the concept of the national minimum beginning with Webbs through Beveridge to the present, suggests that there is an order in protecting the national minimum in terms of the provision and benefit level. The working people, the primary group in protecting the national minimum, has been able to attain the highest benefit level by labor movement. The retired people, the second group, has also been able to protect themselves by social insurance. However, the poor people with no work career, the final and most vulnerable group, could be protected only by social support system based on a strong social solidarity. This argument is supported by the fact that the poverty level was historically low in Great Britain during the period of 1950s when there was the wartime spirit of equality. This paper also argues that the retreat of national minimum after the crisis of the welfare state has been accelerated by the withdrawal of the social solidarity. Because Korean people have not fostered the strong consensus for the equality, it is expected that the NMPL intending to provide the national minimum to all including the poor with no work career can hardly achieve its original goal. To overcome such problem, it is suggested that various social movement groups should integrate their energy in the name of social reform and seek to level up the social consensus on equality.
